Upon receiving notice of the filing of a claim, a response should be submitted to the Fund. The response must be written and will be shared with the claimant. The response should be in letter format. The Fund’s procedures do not provide for pleadings to be filed. The failure to provide a response to a claim will not stop the claim from being processed.
Information provided to the Office of Disciplinary Counsel is not automatically provided to the Fund. Responses to an inquiry received from the Fund, should be sent directly to the Fund. Responses to an inquiry received from the Office of Disciplinary Counsel should be sent directly to the Office of Disciplinary Counsel that has made the inquiry.
We cannot offer a specific time frame as to when the claim will be reviewed. Written notice will be provided to both the claimant and the attorney when the claim is scheduled to be reviewed by the Board.
The claimant and the attorney will receive written notice of the Board’s determination.
Pennsylvania Rule of Disciplinary Enforcement 531 provides that an attorney shall not be reinstated until the full penalty imposed under Rule 531 has been paid in full.
